Terms of Service

By accessing or using the LGSDR platform at lgsdr.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including businesses that register for an account ("Subscribers") and visitors who interact with AI lead cards generated through the platform ("Leads").

LGSDR reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify active Subscribers of material changes via email.

LGSDR provides a SaaS platform that enables local businesses to:

• Generate unique QR codes and AI-powered lead card pages
• Capture lead contact information through AI-assisted chat and forms
• Automate follow-up communications via SMS and email through an AI Sales Development Representative (AI SDR)
• Monitor and manage leads through a business dashboard

The Service is intended for legitimate business use in lead generation and sales follow-up activities.

To use the Service, you must register for an account and provide accurate, complete information including your business name, email address, and payment information.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying LGSDR immediately of any unauthorized access

You must be at least 18 years of age to create an account. Accounts may not be transferred to another party without prior written consent from LGSDR.

4.1 Plans and Fees

LGSDR offers one plan. All features are included.

• Setup Fee: A one-time fee of $99.00 due at registration (non-refundable)
• Monthly Subscription: $69.00 per month, billed monthly

All fees are in US dollars and are non-refundable except as expressly stated in Section 4.4.

4.2 Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize LGSDR to charge your payment method on a recurring basis. You must keep your payment information current and accurate.

4.3 Failed Payments

If a payment fails, LGSDR will notify you via email. Failure to resolve a failed payment within 7 days may result in suspension of your account and deactivation of your AI lead card.

4.4 Refund Policy

The one-time setup fee ($99) is non-refundable. It covers account setup, AI configuration, and QR code generation, all of which are completed immediately upon signup. Monthly subscription payments are non-refundable for the current billing period. You may cancel your subscription at any time to stop future charges.

4.5 Cancellation

You may cancel your subscription at any time through your account billing settings. Cancellation takes effect at the end of your current billing period. Your AI lead card will remain active until that date.

You agree to use the Service only for lawful purposes. You may NOT use LGSDR to:

• Send unsolicited bulk communications (spam)
• Misrepresent your business identity or services
• Collect lead information under false pretenses
• Violate any applicable federal, state, or local law or regulation
• Infringe on the intellectual property rights of any third party
• Transmit harmful, offensive, or fraudulent content
• Attempt to reverse engineer, hack, or disrupt the platform
• Resell or sublicense access to the Service without written permission

LGSDR reserves the right to suspend or terminate any account that violates these terms without prior notice.

The LGSDR platform uses artificial intelligence to generate follow-up messages, chat responses, and lead qualification summaries. You acknowledge that:

• AI-generated content may not always be accurate or appropriate
• You are responsible for reviewing AI SDR messages and ensuring they comply with applicable laws, including CAN-SPAM and TCPA
• LGSDR does not guarantee specific outcomes from AI-generated communications
• You must obtain proper consent from leads before sending SMS messages as required by applicable law

LGSDR is not liable for any outcomes resulting from AI-generated content sent through the platform.

By using the AI SDR feature, you represent and warrant that:

• You have obtained express written consent from leads before sending automated SMS messages as required by the Telephone Consumer Protection Act (TCPA)
• All email communications comply with the CAN-SPAM Act
• You will honor all opt-out and unsubscribe requests promptly
• You will not use the platform to send communications to individuals on the National Do Not Call Registry

LGSDR provides the technology platform only. You, as the Subscriber, are solely responsible for compliance with all applicable telecommunications and marketing laws.

8.1 LGSDR Property

All technology, software, designs, trademarks, and content comprising the LGSDR platform are the exclusive property of LGSDR and its licensors. These Terms do not grant you any ownership rights in the platform.

8.2 Your Content

You retain ownership of all business information, service descriptions, and content you provide to the platform. By using the Service, you grant LGSDR a limited license to use your content solely to provide and improve the Service.

8.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Service may be used by LGSDR without obligation or compensation to you.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

You are responsible for ensuring that your collection and use of lead data through the platform complies with all applicable privacy laws, including but not limited to GDPR and CCPA where applicable.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

LGSDR does not warrant that:

• The Service will be uninterrupted or error-free
• AI-generated content will be accurate or suitable for your needs
• The Service will meet your specific business requirements
• Any particular number or quality of leads will be generated

Use of the Service is at your sole risk.

To the maximum extent permitted by law, LGSDR shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, lost leads, or business interruption.

LGSDR's total liability to you for any claims arising from these Terms or use of the Service shall not exceed the amount you paid to LGSDR in the three months preceding the claim.

You agree to indemnify and hold harmless LGSDR and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Any content you submit through the platform
• Your communications with leads generated through the platform

LGSDR may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any reason at LGSDR's sole discretion with or without notice.

Upon termination:

• Your access to the Service will be immediately disabled
• Your AI lead card and QR code will be deactivated
• Lead data associated with your account may be deleted after 30 days
• Prepaid subscription fees are non-refundable upon termination for cause

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
